An Immigration and Customs Enforcement (ICE) agent has been charged with two counts of assault. Minnesota state prosecutors accused the officer of pulling alongside a civilian vehicle on a Minneapolis-area highway and pointing his gun at the occupants during a road rage incident.
Minnesota prosecutors have issued a nationwide arrest warrant for Gregory Donnell Morgan Jr., marking the first criminal case against an immigration enforcement agent involved in the Minnesota immigration crackdown.
“There is no such thing as absolute immunity for federal agents who violate the law in the state of Minnesota,” Hennepin County Attorney Mary Moriarty stated during a news conference.
According to The Associated Press (AP), Minnesota authorities said the incident occurred on Feb. 5, 2026, when Morgan was on his way back to the ICE offices at the end of his shift.
Details of the Incident
During the press conference, Attorney Moriarty explained that Morgan was driving a rented, unmarked SUV on the shoulder of the highway when a vehicle moved in front of Morgan to try to slow him down.
After the car returned to the legal lane, Morgan proceeded to approach the vehicle and pointed his service firearm at the two people in the car.
“The people in the vehicle had no idea he was a federal agent until a state trooper told them that,” Attorney Moriarty stated.
Potential Pushback from the Trump Administration
“ICE should make arrangements for him to turn himself in,” Attorney Moriarty added. “That warrant will remain out there until we get him in custody.”
A spokesperson for Attorney Moriarty’s office stated “that no arrangement has been made for Morgan to surrender."
The charges against Morgan could bring heat from the Trump administration. Acting Attorney General Todd Blanche has warned state and local officials who arrest federal officers conducting their official duties of being subject to investigations and prosecutions.
Attorney Moriarty assured that she’s not worried about pushback from the Department of Justice, affirming that her office will “hold people accountable if they violate the laws of the state.”
