Earlier this summer, Governor Ron DeSantis’ did right by making the decision to veto a bill that would have permitted more lawsuit abuse by enabling family members to sue doctors and nurses for pain and suffering associated with medical negligence. The law already permits litigation in cases of medical malpractice for actual damages.
Back in 2023, Florida lawmakers passed measures to curb excessive and frivolous litigation brought by attorneys shopping for a big payday. As a caregiver for families who are frequently dealing with a loved one with end of life issues, I know how sad it is when a loved one dies, and if there is any real negligence, medical professionals who have committed legitimate malpractice should be held accountable for their actions.
However, the bill in question was not going to fix the problem of malpractice. It would have burdened Floridians with skyrocketing insurance rates and higher healthcare costs.
Next, our legislature probably needs to look at third party lawsuit financing as the next
area for reform.
