U.S. Rep. Anna Paulina Luna (R-FL) is calling for criminal prosecution and sweeping reforms to the Foreign Intelligence Surveillance Act (FISA) process, arguing that a false intelligence report led to the illegal surveillance of President Donald Trump.
She appeared in an interview with FOX News claiming that officials lied under oath and produced falsified information to secure a FISA warrant allowing for the surveillance of President Trump.
“That false intelligence report resulted in FISA courts issuing a warrant to surveil the president of the United States illegally. Now. And what I can tell you is, if we don't stop this, if we don't, say, this will not be tolerated,” she said.
Rep. Luna continues by saying Americans deserve accountability and that officials must face consequences for their actions.
“We're talking about there needs to be criminal prosecution and arrest, you know, lying under oath, putting out a false intelligence report. And that's a violation of U.S. code 1001 that comes with a seven-year prison sentence and up to $250,000 fine,” she stated.
Luna closed out the interview arguing that the issue goes beyond partisan lines and warned of the broader threat to the nation’s constitutional principles if such actions go unpunished.
“This is not a Democrat or Republican thing. This is about the health and the sanctity of our constitutional republic. And so there needs to be arrests. This is not partisan. This is simply illegal. What they did, and we're simply upholding the law,” she said.
Luna has been a staunch supporter of FISA reform, voting against the reauthorization of Section 702 of FISA in April 2024.
She released a press conference detailing her duty to uphold America’s constitutional rights by rejecting Section 702 of FISA.
“As a member of Congress, it is my duty to uphold the constitutional rights of the American people. Section 702 of the Foreign Intelligence Surveillance Act (FISA) has been utilized to infringe on our privacy rights to conduct warrantless searches on Americans. I am proud to have joined 18 of my colleagues in voting against the irresponsible extension of this program. We saw how FISA was misused in the Russiagate “investigation” to spy on President Trump’s campaign in 2016,” she said.
