Miami-Dade County Mayor Daniella Levine Cava on Tuesday praised a federal ruling blocking the Trump administration's attempt to end temporary protected status (TPS) for 520,000 Haitian migrants living in the U.S.
"Today's ruling blocking the Trump administration's to end Temporary Protected Status (TPS) for Haitians is a vital victory for our community as well as the rule of law," Cava said. By blocking this attempt to strip legal protections from Haitian families, the court has upheld the humanity and dignity of thousands of our neighbors in Miami-Dade and across the country."
"Haitian TPS recipients are essential members of our community - they own homes, run businesses, work in critical industries, and raise children who know no other country as home," Cava continued. "Many fled unimaginable violence and instability to seek opportunity and build new lives here, and they deserve the certainty of continuing protections after following a legal process."
According to a report by Fox News, U.S. District Judge Brian Cogan indicated that Department of Homeland Security (DHS) Secretary Kristi Noem did not follow a timeline or instructions ordered by Congress to review TPS designations for Haitian nationals.
Previously, Noem said TPS was terminated due to improved conditions in Haiti; therefore, Haitians no longer met the conditions for temporary legal protections under the program's policy.
Haiti has a Level 4 travel advisory, designated as "Do Not Travel" by the U.S. Department of State. The highest level of warning, the department advises not to travel to Haiti due to "kidnapping, crime, civil unrest, and limited health care."
About 700 miles from Miami, Haiti has been rocked by civil unrest and gang violence for years, including in its capital of Port-au-Prince. According to reports, roughly 90% of the capital is controlled by gangs.
TPS for Haitians was to expire on Aug 3, 2025, with the termination going into effect on Sept 2, 2025. About 128,000 Haitians in Florida have TPS.
Cava criticized the Department of Homeland Security (DHS) for previously terminating TPS for Haitians on Friday.
