In a social media post, Florida Attorney General James Uthmeier urged the House Legislature to impeach Tallahassee Judge Tiffany Baker after revoking bond for the alleged killer of 5-year-old Melissa "Missy" Mogle in May 2025.
Daniel Spencer, Mogle's stepfather, was let out on bond by Baker despite a conviction and awaited sentencing for trying to meet a minor for sex, with state prosecutors asking Baker to revoke his bail. Spencer allegedly killed Mogle weeks after being released in their home.
Spencer's trial on charges related to Missy's death is scheduled for June.
In the aftermath, Gov. Ron DeSantis signed "Missy's Law," which requires a judge to immediately revoke bond and hold defendants in custody after being convicted of dangerous, violent, or sexual crimes. DeSantis also suggested the House impeach Baker.
"Until we start holding these judges accountable, they are going to continue to find ways to benefit the criminal element," DeSantis said at the time of the signing. "This was an outrage. This was such an easy call to make sure that this guy was put behind bars, and this judge refused to do it, knowing the risks, and the result is obviously been a tragedy."
Uthmeier also urged the House to impeach Miami-Dade Judge Richard Hersch after giving bond to a 12-year-old boy charged as an adult for shoving rocks in a 12-year-old girl's mouth as she allegedly was being raped by another teen.
According to the Florida Constitution, two-thirds of 'Yes' votes by the House are required for impeachment. The officer is immediately suspended until final conviction by the Senate, which also requires a two-thirds vote.
The Legislature is currently in Tallahassee for a special session from May 12 to May 29 to pass the state budget. However, other matters can be discussed, but it is unclear if the House will proceed with impeachment proceedings against Baker during that time.
