Gen. Dan Caine Urges Renewal Of FISA 702 Amid Privacy Concerns

A pivotal tool of the U.S. intelligence community is set to expire on Apr. 20, 2026. As the clock approaches, Joint Chiefs Gen. Dan Caine sent federal officials a letter urging federal lawmakers to support the White House’s efforts to an 18-month “clean renewal” of the legislation, according to reports from Politico.

Section 702 of the Foreign Intelligence Surveillance Act (FISA 702) is crucial to U.S. military personnel. It has “sufficient guardrails in place to protect Americans, despite widespread privacy concerns,” according to a copy of the correspondence received by Politico.

“The loss or reduction of FISA section 702 authorities would increase risk to the Joint Force, degrade our worldwide combat lethality, and significantly impair U.S. security,” Gen. Caine wrote.

According to an anonymous White House Official who spoke with Politico, Gen. Caine issued the correspondence “to the committees on Intelligence, Armed Services, Defense Appropriations, and Judiciary in both chambers.”

Efforts to Propose a Vote by the House

House Speaker Mike Johnson is attempting to shoehorn the extension through the Rules Committee to set up a floor vote later in the week.

Despite the law being significant in performing international counterterrorism and trafficking, several congressmembers from both sides are concerned with the legislation’s ability to allow the federal government to access communications data from American citizens without a warrant – a constitutional violation of their right to privacy.

"When used properly, FISA is an effective tool to keep Americans safe. For these reasons, I have called for a clean 18-month extension," Trump previously wrote in a post on Truth Social in March. "With the ongoing successful Military activities against the Terrorist Iranian Regime, it is more important than ever that we remain vigilant, PROTECT our Homeland, Troops, and Diplomats stationed abroad, and maintain our ability to quickly stop bad actors seeking to cause harm to our People and our Country."

A position from the president that appears to be a stark contrast from his previous opinion in which he stated, “KILL FISA, IT WAS ILLEGALLY USED AGAINST ME, AND MANY OTHERS,” during former President Joe Biden’s administration in Apr. 2024.
