James Fishback Pledges Return of Nativity Scenes on Government Property

Florida gubernatorial candidate James Fishback (R) vowed to bring back nativity scenes to government property to honor the birth of Jesus Christ if elected to the governor's mansion this week.

Fishback, who is catholic, critcized a 1989 Supreme Court case that ruled nativity scenes on government property violated the Establishment Clause and therefore were illegal. The 5-4 decision, Allegheny v. ACLU, came after a nativity scene was placed inside the Allegheny County Courthouse with a banner that read  "Glory to God for the birth of Jesus Christ," with the Court finding it an endorsement of Christianity by the county.

However, the court upheld another ruling involving a menorah next to a Christmas tree outside the City-County building, finding that it essentially recognized a combined secular celebration rather than a specific religion.

"The Court's ruling in 'Allegheny v. ACLU' was an affront to our Constitution and an insult to the Christians who founded our country," Fishback wrote.

Fishback called the nativity scene a representation of the "birth of our King" and the "only true symbol of Christmas" in his statement. He also indicated the current Supreme Court's Conservative majority would overturn the ruling.

"There is no question that today's Supreme Court would overturn Allegheny vs ACLU, just as it overturned Roe vs Wade, and that is only possible because of President Trump's appointments of Justices [Neil] Gorsuch, [Brett] Kavanaugh, and [Amy] Coney Barrett.

President Donald Trump nominated Neil Gorsuch to the U.S. Supreme Court in 2017, Brett Kavanaugh in 2018, and Amy Coney Barrett in 2020. The appointments helped create a conservative majority on the court for many future rulings, including Roe v. Wade.

"Our great state of Florida will never hide its Christian heritage, or apologize to activists who distort the Constitution and shame us for our faith," Fishback wrote. "We will proudly say: Joy to the world; the world is come; Let Earth receive her King."
