Special Counsel Jack Smith has dropped his charges against President-elect Donald Trump on Monday, a move which several Florida Republicans, including Representatives Byron Donalds (R-FL), Anna Paulina Luna (R-FL), Mike Waltz (R-FL), and Senator Rick Scott (R-FL) celebrated on X (formerly Twitter), deriding the case Smith made as "lawfare" that was finally ending.
Forbes detailed the dismissal, noting that Smith and the prosecution sought to drop the case before Trump's inauguration on January 20th, as the Department of Justice (DOJ) does not prosecute sitting presidents.
Additionally, Smith's election subversion charges were requested to be dropped as the DOJ has "never faced the circumstance here, where a federal indictment against a private citizen has been returned by a grand jury, and a criminal prosecution is already underway when the defendant is elected President." Judge Tanya Chutkan dismissed the case without prejudice.
However, the Special Counsel said he would continue appealing the July dismissal of the Trump classified documents case involving two other defendants.
Nevertheless, Republicans are taking a victory lap on social media, saying Smith's actions prove his case was politically motivated all along.

Similarly, Rep. Waltz tweeted, "The politically motivated lawfare against President Trump was a farce from the beginning. The rule of law in America WON today."

Rep. Luna said she was "not surprised" by Smith's dropping of the charges, as "It was political persecution all along! This is a major victory for the rule of law. The government should never be weaponized to persecute political opponents. Jack Smith will be held accountable."
