Even as Americans worry more about recession and inflation, the Biden Administration and Democrats continue to push woke policies. The latest is a proposed inclusion of "gender identity" under Title IX, the statute protecting against discrimination of women in education.
Late this past week, Senator Marco Rubio (R-FL) sent a letter to Secretary of Education Miguel Cardona questioning the inclusion.
Rubio's questions are certainly biting. That is, unless one already affirms biological sex cannot change by "identifying" as the other. The two first examples cite instances of students and a teacher refusing to use another student's preferred pronouns. The students receive Title IX complaints and the teacher receives suspension.
The letter asks if these violate the reformed Title IX, and if teachers would receive religious or conscientious exemptions to the rule.
Additionally, the letter targets schools denying parental rights. Not only are schools withholding information about their children's "gender identity," but in some instances required unless asked. Rubio cites school directives from Washoe County, Nevada, as an example. Naturally, the issue of boys competing in girls' athletic programs is included.
The Department of Education argued Title IX violations when West Virginia prohibited biological males from competing in female athletic programs. The letter asks if this is indeed a violation of Title IX if a man "identifies" as a woman to compete in women's athletics and is prohibited from doing so.
Rubio is not the first Florida Republican to speak out against female-identifying men in women's sports. Back in March, Governor Ron DeSantis accused the NCAA of "destroying" women's athletics for its inclusion of transgender athletes.
Overall, the letter speaks of including gender identity under Title IX as self-contradictory and rendering itself pointless. Such a move would make sports and restrooms "unsafe and unfair for women and girls." Furthermore, wider implications would be the erosion of "women's rights, free speech rights, parental rights, and children's safety and innocence."
