Some Republicans in the House of Representatives are pushing for the impeachment of District of Columbia District Court Judge James Boasberg after he issued rulings to block President Donald Trump’s deportation of hundreds of alleged Venezuelan gang members.
Judge Boasberg ruled President Trump’s deportation flights of the Tren de Aragua (TDA) members ought to turn around after receiving complaints that they had been removed from the US unlawfully.
Boasberg's ruling questions the Trump administration’s authority to invoke the Alien Enemies Act – which it did when deciding to remove nearly 300 TDA members.
Consequently, Trump, administration officials, and various Republicans in the House of Representatives subsequently called for Boasberg’s impeachment.
“Judge Boasberg’s unconstitutional overreach is a blatant attempt to run U.S. foreign policy from the bench,” said Representative Brandon Gill (R-TX). “Congress has the constitutional power to impeach rogue activist judges—and we intend to use it.”
Representative Gill has filed articles of impeachment against Boasberg, arguing he abused his power when attempting to prevent TDA members’ deportation.
"This judge, like many of the Crooked Judges’ I am forced to appear before, should be IMPEACHED,” said Trump via Truth Social. “WE DON’T WANT VICIOUS, VIOLENT, AND DEMENTED CRIMINALS, MANY OF THEM DERANGED MURDERERS, IN OUR COUNTRY.”
Gill’s impeachment resolution has reportedly gained the support of Representatives Eli Crane (R-FL), Andy Ogles (R-TN), Buddy Carter (R-GA), Barry Moore (R-AL), Mike Collins (R-GA), and Andrew Clyde (R-GA).
Democrats and some top judicial branch officials have rejected Trump’s impeachment calls.
Supreme Court Chief Justice John Roberts rebuked the impeachment idea, arguing that impeaching a judge over legal disagreements ignored the appeals process designed to settle legal disputes.
“For more than two centuries, it has been established that impeachment is not an appropriate response to disagreement concerning a judicial decision,” Chief Justice Roberts said. “The normal appellate review process exists for that purpose.”
Over a dozen judges have been impeached throughout US history.
Indeed, the only eight individuals to be convicted and removed following impeachment proceedings were all federal judges.
