I want to thank Governor DeSantis and the Florida legislature for the work that they did this year to halt lawsuit abuse. Lawsuit abuse is a problem that has plagued Floridians for decades. It is not appropriate to blame the trial lawyers. Any lawyer should use every tool at his or her disposal to help a client, but the laws needed to be changed.
One of the prime ways they were helping clients in the past was by hiding or obscuring the actual damages under consideration in our courtrooms and by juries. Essentially, trial lawyers were utilizing legal loopholes to inflate a plaintiff’s medical bills so they could get stronger judgments. That was just not fair.
Creating new guidelines for transparency will make that better and lead to a fairer system for everyone. Everyone needs access to the courts when damage has been done, but not an unfair advantage.
