Election Complaint Filed Against Daniella Levine Cava

The stage is set for the Miami-Dade County Mayoral race between Steve Bovo and Daniella Levine Cava. However, with the election taking place in less than 40 days, Levine Cava is finding herself in some hot water as she has just had an election complaint directed her way. And, this complaint could ultimately spell out bad news for the Mayoral hopeful.

In the complaint filed by a Miami-Dade County resident, it’s explained that “despite the fact that the Miami Code of Ordinances requires the Mayoral race to be nonpartisan, and state law prohibits candidates running for non-partisan office from stating the candidate’s political party affiliation in a disclaimer or in the body of an advertisement, Ms. Cava is outwardly running as a Democrat in violation of the law.”

The resident who filed the complaint provided a mailing of the advertisement, and in the advertisement, Cava lists herself as “Democrat Daniella Levine Cava.”

The advertisement also shows that it was distributed by the Miami-Dade Democratic Party and by the Florida Democrats.

 

Moreover, the complaint argues that “Cava… appears to be engaged in a continuing pattern and practice of running as a Democrat notwithstanding that the Mayor of Miami-Dade County is a nonpartisan office.”

In a letter directed to Bert Medina, the General Manager of WPLG, the resident also highlights that the station is running advertisements that are clearly partisan, saying that the advertisements “promote Mayoral candidate Levine Cava as a Democrat which violates state statute and county ordinance in the non-partisan office” and “the ads do not bear proper legal disclaimers as defined by statute.”

 

Cava has not responded to the complaint filed against her by the Miami-Date resident, but the complaint comes at a time when Cava is polling higher than Bovo with South Floridians.

And, this could have grave repercussions on her Mayoral aspirations.
